Case Management Decisions

Michael Smith - Coach, Cambridgeshire

24 January 2012

On 4th January 2012 a Case Management Group ("CMG") of UK Athletics chaired by Mr G.  Heeley met to decide whether Michael Smith a coach associated with Cambridge and Coleridge AC should have their UKA Coach Licence withdrawn.

The CMG considered the evidence put before them and determined that one of the circumstances for withdrawal of a licence set out in condition 6.1 of the Coach Licence Terms and Conditions existed.  Accordingly they recommended, under Condition 6.2 that his coach licence be withdrawn for a period of nine years with effect from the 4th January 2012.

Michael Smith may apply for a licence after the 4th January 2021 but any such application must satisfy the general coach licesing conditions in force at that time.

Robert Sloan - Athlete

1st December 2011.

Following an investigation by England Athletics, an Independent Disciplinary Panel chaired by Mr. Walter Nicholls (Solicitor) met on the 3rd November 2011 to consider allegations of misconduct against Mr. Robert Sloan, an athlete formely with Sunderland Harriers.

The outcome of the hearing was that Mr. Robert Slaon is to be suspended from all competition or from taking part in any event organised or run under the UKA rules of competition for a period of 6 months dated back from 9th October 2011.  Mr. Sloan declined the opportunity to appeal the panels decision, the suspension will cease on Monday 9th April 2012 at midnight.

Incident at National Junior Athletics League 29th May 2011 in Chelmsford

1.         Reece Morgan 18years athlete with Shaftesbury Barnet AC

2.         Jordan Rohan Arthur 19yrs athlete with Enfield & Haringey AC

3.         Anthony Ekundayo 19yrs athlete with Enfield & Haringey AC

This incident was referred to UKA under Section 22 (3) of its Rules for Competition by the Management Committee of the NJAL following various complaints and adverse comments made to them after the event.

UKA referred the matter to England Athletics for investigation and David Brown CBE was appointed as the Investigating Officer.

On the 5th July 2011 an England Athletics Disciplinary panel chaired by Mr Stewart Barnes met to consider the following allegations against the above named athletes.

Misconduct  5.1.1.5

Behaved in a manner which is disgraceful or opposed to the general interests of England Athletics or the sport of athletics or which brings the sport into disrepute.

Misconduct 5.1.1.6

Behaved in a manner that is otherwise considered by England Athletics to be unacceptable and contrary to the conduct expected of a person participating in athletics.

Serious misconduct 5.1

Behaving in a physically violent manner towards another

Circumstances

This matter arises from an incident(s) which took place at and immediately after a NJAL Southern Premier fixture at Chelmsford Athletics Centre on the 29th May 2011.

What is apparent from the evidence is that Reece Morgan instigated an argument with Jordan Arthur whilst preparing for the 4 x 100m relays. The two squared up to each other and had to be split up by the intervention of club officials and coaches.

The meeting concluded and the teams left the facility to board their respective buses ready to travel home.

There then followed a large scale disturbance on the car park involving all three defendants with many other athletes and officials trying to break up the incident.

Athletics has long had an ethos of being a friendly sport with valid rivalry but within acceptable boundaries. This incident is totally unacceptable to the sport and a strong and clear signal should be sent out to those who wish to sully the name of the leagues and the sport in general.

The panel imposed the following sanctions:-

With immediate effect all three athletes were suspended from participation in all track and field league competitions held under UKA and/or IAAF rules until after the 30th June 2012.

Douglas Hanna

20th June 2011

On the 1st June 2011 under section 2.3 of the Coach licence Terms and Conditions and Section 1 Technical Officials licence Terms and Conditions UKA decided that they had sufficient grounds not to renew the coach and officials licences previuosly issued to Douglas Hanna.

Mr. Hanna was entitled to request UKA reconsider that decision which he did.

On 13th June 2011 a Case Management Group (CMG) of UKA chaired by Mr. G Heeley met to decide whether Douglas Hanna should have his Coach and Officials licences renewed.

The CMG considered the details put before them and determi9ned that one of the corcumstances for not renewing a licence set out in section 2.3 of the Coach Licence Terms and Conditions and Section 1 Techincal licence Terms and Conditions existed.  Accordingly they ratified the decision of UKA on the 1st June not to renew the coach and officials licence of Douglas Hanna.

Matthew Baldock – Athlete

Following an investigation by UKA an England Athletics Disciplinary panel chaired by Mr Stewart Barnes (Regional Council) met on the 5th April 2011 to consider two allegations against Matthew Baldock an athlete with Birchfield Harriers. This followed Mr Baldock’s conviction at Warwick Crown Court.

The panel found the case proved and imposed the following sanctions:-

A recommendation to Birchfield Harriers of which he is a member to terminate his membership with immediate effect.

That Baldock is suspended from competition or from taking part in any event organized or run under the UKA rules of Competition for a period of seven years.

Mr Baldock lodged a notice of appeal in respect of the sanctions.

On the 4th May 2011 an England Athletics Appeal Panel chaired by Mr Walter Nicholls (Solicitor) assisted by Mr E Royle JP and A Lee, Team Leader England Athletics met in Manchester to consider the matter.

The panel decided that the athletes appeal fails and the findings and sanctions of the England Athletics Disciplinary panel be upheld. A full narrative from the panel is held by UKA.

The appeal panel clarified that the ban commenced on the date of the athletes conviction at the Crown Court i.e. 7 October 2010.

Marcel Joseph Gray

21st April 2010

On 20th March 2010 a Case Management Group ("CMG") of UK Athletics chaired by Mr Graham Heeley met to decide whether Marcel Joseph Gray should have their UKA Coach Licence withdrawn.

The CMG considered the evidence put before them and determined that one of the circumstances for withdrawal of a licence set out in condition 6.1 (in specific terms condition 6.1 (viii) falsification of coaching qualifications) of the Coach Licence Terms and Conditions existed.  Accordingly they recommended, under Condition 6.2 that his coach licence be withdrawn.

 Mark Liversidge 

04/01/2010

On 2nd December 2009 a Case Management Group (“CMG”) of UK Athletics chaired by John Temperton met to decide whether Mark Liversidge should have his UKA Technical Officials Licence withdrawn.

The CMG considered the evidence put before them and determined that one of the circumstances for withdrawal of a licence set out in condition 5.1 of the Technical Officials Licence Terms and Conditions existed. Accordingly they recommended, under Condition 1.1 that his officials licence be withdrawn for a period of five years. The CMG also determined that Liversidge should not be used in any capacity at any UKA licensed/permit event at whatever level.

After the 2nd December 2014 Liversidge may apply for a licence but any such application must satisfy the general officials licensing conditions in force at that time.

Andrew Edwards 

12th May 2009

On 31st March 2009 a Case Management Group (“CMG”) of UK Athletics chaired by Mr Graham Heeley met to decide whether Andrew Edwards should have their UKA Coach Licence withdrawn.

The CMG considered the evidence put before them and determined that one of the circumstances for withdrawal of a licence set out in condition 6.1 of the Coach Licence Terms and Conditions existed. Accordingly they recommended, under Condition 6.2 that his coach licence be withdrawn.

In the future Andrew Edwards may apply for a licence but any such application must satisfy the general coach licensing conditions in force at that time.

Kenneth Phillips

15 October 2008

On 10 September 2008 a Case Management Group (“CMG”) of UK Athletics chaired by Mr Graham Heeley met to decide whether Kenneth Phillips should have his UKA Technical Officials Licence withdrawn.

The CMG considered the evidence put before them and determined that one of the circumstances for withdrawal of a licence set out in condition 5.1 of the Technical Officials Licence Terms and Conditions existed. Accordingly they recommended, under Condition 1.1 that his officials licence be withdrawn.

Mr Phillips may apply for a licence but any such application must satisfy the particular conditions laid down by UK Athletics in this case together with the general officials licensing conditions in force at that time.

Ian Pudge

15th October 2008

Mr Pudge may apply for a licence in the future but any such application must satisfy the general coach licensing conditions in force at that time.

James Bryce

14th January 2010

On 12th January 2010 a Case Management Group (“CMG”) of UK Athletics chaired by Mr Tony Carter met to decide whether James Bryce should have his UKA Coach Licence reinstated following a fixed period of suspension.

The CMG considered the evidence from interested parties and Mr Bryce and determined that one of the circumstances for refusal to grant a licence set out in condition 2 of the Coach Licence Terms and Conditions existed. Accordingly they recommended, under Condition 2.4 that his application for a licence be refused.

30 April 2008

 An Independent Panel, chaired by Dr D Thompson of the Sports Dispute Resolution Panel has rejected an appeal by James Bryce against the restriction previously imposed on his coaching licence by UKA .

The Panel heard oral evidence from witnesses and,  having considered the evidence in relation to Mr Bryce's breach of the Coaches' Code of Conduct put before them ,  enhanced the penalty   from the original restriction to a full withdrawal of  the  licence .

The panel took into account that Mr. Bryce had been suspended from coaching for a period of nine months and have withdrawn his licence completely for a further fifteen months from the 23rd April 2008.

 


Simon Richardson

On 14th December 2007 a Case Management Group (“CMG”) of UK Athletics chaired by Zara Hyde Peters met to decide whether Simon Richardson should have their UKA Coach Licence withdrawn.

The CMG considered the evidence put before them and determined that one of the circumstances for withdrawal of a licence set out in condition 6.1 of the Coach Licence Terms and Conditions existed. Accordingly they recommended, under Condition 6.2 that his coach licence be withdrawn.
